En "udstationeret arbejdstager" er en ansat, der er udsendt af vedkommendes arbejdsgiver for at levere en tjenesteydelse i en anden EU-medlemsstat på et midlertidigt grundlag. Etableringsfriheden og den frie udveksling af tjenesteydelser er grundlæggende frihedsrettigheder, der er nedfældet i traktaten om Den Europæiske Unions funktionsmåde (TEUF). Princippet om udstationerede arbejdstageres status er "lige løn for samme arbejde på samme sted".

EU supplerer medlemsstaternes aktiviteter for så vidt angår arbejdstagernes ret til information og høring ved at indføre minimumskrav ved hjælp af direktiver eller gennem foranstaltninger med henblik på at fremme samarbejde mellem medlemsstaterne. En række EU-direktiver beskytter arbejdstagernes ret til information og høring på virksomhedsniveau ved at fastsætte regler på både nationalt og tværnationalt plan.
