Ο αποσπασμένος εργαζόμενος είναι ένας εργαζόμενος που έχει σταλεί από τον εργοδότη του να παράσχει μια υπηρεσία σε άλλο κράτος μέλος της ΕΕ σε προσωρινή βάση. Η ελευθερία εγκατάστασης και η ελευθερία παροχής υπηρεσιών αποτελούν θεμελιώδεις ελευθερίες που κατοχυρώνονται στη Συνθήκη για τη λειτουργία της Ευρωπαϊκής Ένωσης (ΣΛΕΕ). Η αρχή που διέπει το καθεστώς των αποσπασμένων εργαζομένων είναι η «ίση αμοιβή για όμοια εργασία στον ίδιο τόπο».
Δικαίωμα των εργαζομένων στην ενημέρωση, τη διαβούλευση και τη συμμετοχή
Η Ευρωπαϊκή Ένωση συμπληρώνει τις δραστηριότητες των κρατών μελών όσον αφορά το δικαίωμα των εργαζομένων στην ενημέρωση και τη διαβούλευση, θεσπίζοντας ελάχιστες απαιτήσεις μέσω οδηγιών ή μέτρων που έχουν σκοπό να ενθαρρύνουν τη συνεργασία μεταξύ των κρατών μελών. Ορισμένες οδηγίες της ΕΕ προστατεύουν τα δικαιώματα των εργαζομένων στην ενημέρωση και τη διαβούλευση σε επίπεδο εταιρείας, θεσπίζοντας κανόνες τόσο για το εθνικό όσο και για το διακρατικό επίπεδο.
Ελεύθερη κυκλοφορία των εργαζομένων
Μία από τις τέσσερις ελευθερίες των πολιτών της ΕΕ είναι η ελεύθερη κυκλοφορία των εργαζομένων. Περιλαμβάνει τα δικαιώματα μετακίνησης και διαμονής των εργαζομένων, τα δικαιώματα εισόδου και διαμονής των μελών της οικογένειας, το δικαίωμα εργασίας σε άλλο κράτος μέλος και το δικαίωμα σε ίση μεταχείριση με τους υπηκόους του εν λόγω κράτους μέλους.
