On 27 July 2017, the UK Financial Conduct Authority (FCA) announced its resolution to phase out the London Interbank Offered Rate (LIBOR) by the end of 2021. On 27 July 2017, the UK Financial Conduct Authority (FCA) announced its resolution to phase out the London Interbank Offered Rate (LIBOR) by the end of 2021. As supervisor of the LIBOR, the FCA wanted to allow for a smooth transition to alternative reference rates of this widely used benchmark. On 24 July 2020, the European Commission adopted a proposal to amend the Benchmarks, Regulation. The most important part of this proposal is to regulate the replacement rate of a benchmark in cessation (in this case: LIBOR) and to avoid a legal vacuum. This amendment would empower the European Commission to designate, by an implementing act, a statutory replacement rate to replace the reference to the benchmark in cessation, if this cessation may result in significant disruption of financial markets in the Union.

Directive 2011/36/EU (Anti-Trafficking Directive) is the benchmark legislation on the fight against human trafficking at European level. The aim of this European implementation assessment is to gather evidence on the progress and challenges that occur in the implementation of the directive in the Member States, with a double focus: the migratory context and gender issues. Almost 10 years after its adoption, the Anti-Trafficking Directive remains a valuable tool in combating trafficking in human beings in the European Union (EU). Nevertheless, the evaluation points out the need to continue efforts to ensure the application of its provisions in all the directive's main aspects. The persisting grey areas and obstacles are significant enough to put the full achievement of the directive's objectives at risk.

Adjusted European Commission work programme 2020

The European Commission presented its work programme for 2020 in January. Shortly after however, the Covid-19 pandemic happened, forcing the Commission to focus its efforts on the immediate crisis management. This led to the need to recalibrate and adjust the original Commission Work Programme - this adjusted CWP was presented at the end of May. This briefing provides and overview and analysis of the main changes between the original / January CWP 2020, and the adjusted / May CWP.

The study reflects on the design and implementation of the current Strategy, as well as its achievements and shortcomings. The study makes recommendations in respect of the post-2020 European Disability Strategy. Those recommendations are addressed to the European Parliament, the European Commission and other EU institutions, Member States and key stakeholders, and relate to the groundwork needed to prepare the new Strategy, and the design, content and mechanisms for implementation and enforcement.

Este estudio presenta una evaluación y conclusiones relativas a la aplicación de la Decisión Marco sobre la ODE. A petición del ponente, también contiene recomendaciones sobre el modo de subsanar las deficiencias detectadas. Su objeto es contribuir a los debates del Parlamento en la materia, a fin de mejorar la comprensión de este tema y, en última instancia, servir de aportación al informe de aplicación. En el estudio se llega a la conclusión de que la Decisión Marco sobre la ODE ha simplificado y acelerado los procedimientos de entrega, en particular en algunos casos destacados de delincuencia grave y terrorismo. Sigue habiendo varios retos pendientes, que están relacionados con los principales debates sobre la independencia judicial, la naturaleza del reconocimiento mutuo y su relación con el Derecho y los valores internacionales y de la Unión Europea, los principios constitucionales y la necesidad de adoptar medidas adicionales de armonización. Además, existen deficiencias en la eficacia, la eficiencia y la coherencia con otras medidas y la aplicación de herramientas digitales. El estudio recomienda que se establezcan procedimientos de infracción específicos, que se apoye a las autoridades judiciales, que se permita la audiencia de los sospechosos mediante un enlace de vídeo, cuando proceda, para evitar la entrega y garantizar al mismo tiempo el ejercicio efectivo de los derechos de la defensa, y que se adopte una serie de medidas destinadas a lograr un trato humanitario de los presos. A medio plazo, por razones de legitimidad, seguridad jurídica y coherencia, el estudio recomienda que se revise la Decisión Marco sobre la ODE en el contexto de la elaboración de un código de cooperación judicial de la Unión Europea en materia penal.

Better Regulation practices in national parliaments

Both tools are geared towards raising the quality of policies and legislation. While Better Regulation is widely deemed a prerogative of the executive branch, increasingly, parliaments are also emerging as actors. This study sheds light on the parliamentary dimension of Better Regulation. Based on a survey, it maps the capacities and experiences of the national parliaments of all 27 European Union (EU) Member States and of 11 further Council of Europe countries in the field of ex-ante impact assessment and ex-post evaluation. The study reveals that roughly half of the surveyed parliaments engage in regulatory policy beyond classical parliamentary scrutiny mechanisms. Overall, these parliaments show a very diverse pattern in terms of drivers, types and depth of engagement. There is no 'one size fits all' approach.

The EIA presents progress and challenges in the implementation of reforms in this Eastern Partnership country since July 2018, when a previous report was published, until now. The EIA consists of two parts, an opening analysis prepared internally by the DG EPRS and a briefing paper prepared externally by the Centre of Eastern Studies (OSW). The EIA has been prepared to accompany the European Parliament Committee on Foreign Affairs (AFET) in its scrutiny work, namely on its work on the own-initiative annual implementing report on the EU association agreement with Moldova.

While the E-commerce directive has been the cornerstone of the Internal Market for the last twenty years, Members of the European Parliament´s Internal Market and Consumer Protection Committe noted that the Digital Single Market is affected by increasing fragmentation in tackling illegal content online, difficulties to promote market entry and consumer welfare, and ineffectiveness of enforcement and cooperation between Member State. In order to improve functioning of the Single Market, IMCO Committee took the initiative to prepare a legislative report with recommendations to the Commission on a Digital Services Act (Rapporteur: MEP Alex Agius Saliba) and organised a workshop on “E-commerce rules, fit for the digital age” during which MEPs discussed with experts, stakeholders and consumer protection organisations possibilities of efficient reforms of regulation and consumer protection on online marketplaces in the European Union. This collection of studies presents workshop proceedings and expert studies resulting from the ongoing interest of the Committee on the Internal Market and Consumer Protection in improving the functioning of the Digital Single Market and developing e-commerce rules based on scientific evidence and expertise.

The study provides a synthesis of evaluations and opinions of the Framework. It gives an appreciation of the coordination, consultation and monitoring structures and the way they work out in practice. It also looks at the interplay with other EU legal, funding and policy instruments. It then reviews the main policy objectives, namely (Roma access to) education, employment, health, housing, as well as anti-discrimination and anti-gypsyism.
