Um «trabalhador destacado» é um trabalhador temporariamente enviado pelo seu empregador para outro Estado-Membro da UE a fim de aí prestar um serviço. A liberdade de estabelecimento e a liberdade de prestação de serviços são liberdades fundamentais consagradas no Tratado sobre o Funcionamento da União Europeia (TFUE). O princípio que rege o estatuto dos trabalhadores destacados é «o salário igual para trabalho igual no mesmo local».

A União Europeia complementa as atividades dos Estados-Membros em matéria de direitos dos trabalhadores à informação e consulta, adotando, para tal, requisitos mínimos por intermédio de diretivas ou de medidas destinadas a fomentar a cooperação entre os Estados-Membros. Várias diretivas da UE protegem os direitos dos trabalhadores à informação e à consulta a nível das empresas, estabelecendo regras tanto a nível nacional como transnacional.
