En utstationerad arbetstagare är en arbetstagare som är utsänd av sin arbetsgivare för att tillfälligt utföra en tjänst i en annan EU-medlemsstat. Etableringsfriheten och friheten att tillhandahålla tjänster är grundläggande friheter som fastställs i fördraget om Europeiska unionens funktionssätt (EUF-fördraget). Principen som gäller för utstationerade arbetstagare är ”lika lön för samma arbete på samma plats”.

Europeiska unionen kompletterar medlemsstaternas insatser vad gäller arbetstagares rätt till information och samråd genom att anta minimikrav med hjälp av direktiv eller genom åtgärder avsedda att uppmuntra till samarbete mellan medlemsstaterna. Ett antal EU-direktiv skyddar arbetstagarnas rätt till information och samråd på företagsnivå genom att fastställa regler på både nationell och gränsöverskridande nivå.

Den fria rörligheten för arbetstagare är en av EU-medborgarnas fyra friheter. Den omfattar arbetstagarnas rätt till rörlighet och uppehälle, familjemedlemmars rätt till inresa och uppehälle och rätten att arbeta i en annan medlemsstat och att behandlas på lika villkor som medborgarna i den medlemsstaten. Begränsningar gäller för den offentliga sektorn. Europeiska arbetsmyndigheten är ett särskilt organ för den fria rörligheten för arbetstagare, däribland utstationerade arbetstagare.
